Is Capital Punishment A Violation of the 8th Amendment? Eagster: As a Libertarian I think it's counter to what the goal of the death penalty is, achieving justice. taking someone's life for commiting a crime is hardly justice, fair, logical or reasonable. Anyways back to the question, is it a violation of the constitution? Eagster: Just for the record I'm not a lawyer or legal scholar just asking questions that should be asked, thank you calybonos: I don't think it can be ever used to achieve justice. It's a good means of revenge, but not much of a deterrent to crime. Still,I think it should be used on cases with extenuating circumstances. Like someone in front of me who drives to slow when im in a hurry,or white guys rapping. OCD_OCD: Supreme Court says "no". http://www.capitalpunishmentincontext.org/resources/casesummaries There's a list of all of the judicial reviews and the reasons. lavendar_star: I have no idea if its constitution as I'm not American but I don't think it prevents people from committing crime or makes society safer, if its OK for the state to kill not exactly setting a good example for the rest of society. I think its cool for white guys to rap; equal opportunities for all but then I'm British and the urban music scene is here not about race it just about taste some of our best British rappers are white doing it UK styley!!!!! OCD_OCD: Here we have states that have Life Without Parole (LWOP) or Life. With those states that have Life, they can still be paroled and go back out into society. LWOP (supposedly) means that they will die in prison. It's the only life sentence that really means a life sentence. lavendar_star: This is a global site the OP should tell people what the 8 th constitution is!!!"Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted." If that's it, then frying someone in the electric chair or the needle does sound like cruel and usual punishment and sometime the death doest go smoothly. I just think it says something that the US is the only western country that has the death penalty. OCD_OCD: Some of the countries of South America have the death penalty, but they only use it under special circumstances. SillySally8: heres a twist ocd lwop....we the tax payers make sure they have a roof over their head...a bed to sleep indoors on and 3 meals/day R E B E C C A: I hear ya Gary!! Seems to me that there's so many freaking amendments to wotever it is that's been amended idk why they don't just scrap it n start a new "wotever" minus all the mistakes kinggary377: Hia Rebecca i know we should make an amendment to amend the amendments i couldnt have said that the other day lol Eagster: @Ocd I disagree with any decision condoning it but hey, it's the supreme court, whatcha gonna do. Eagster: @King Eighth amendment has a number of rules in it, the one I'm referring to is the rule that prohibits the federal government from executing people in a cruel or unusual way. kinggary377: ok t/y i myself believe in Capital punishment but no differences in who is murdered all get the same but swiftly carried out kinggary377: yes but all killers should get a fair trial then be executed no difference in who they kill kinggary377: maybe but i am not that liberal i dislike it when people say only execute for killing police or other members of society one law for all i think Eagster: Lavender -"I just think it says something that the US is the only western country to have the death penalty" lol that's called American exceptionalism. duncan124: I don't think you can have a State where the people can kill in self defense but the State can just imprison people. | Off Topic Chat Room Similar Conversations |
