Is Capital Punishment A Violation of the 8th Amendment? Eagster: As a Libertarian I think it's counter to what the goal of the death penalty is, achieving justice. taking someone's life for commiting a crime is hardly justice, fair, logical or reasonable. Anyways back to the question, is it a violation of the constitution? Eagster: Just for the record I'm not a lawyer or legal scholar just asking questions that should be asked, thank you  calybonos: I don't think it can be ever used to achieve justice. It's a good means of revenge,but not much of a deterrent to crime. Still,I think it should be used on cases with extenuating circumstances. Like someone in front of me who drives to slow when im in a hurry,or white guys rapping. OCD_OCD: Here we have states that have Life Without Parole (LWOP) or Life. With those states that have Life, they can still be paroled and go back out into society. LWOP (supposedly) means that they will die in prison.
