Due process means that there is a reasonable expectation that information could be gleaned from tracking that person. Not that they "think" it might work out. The authorities have to do their due diligence and go through the hoops before you can potentially circumvent someone's rights. You can also be dragged in before a Grand Jury and it is their decision whether or not to true bill. It really all depends on the agenda of the person making the decision doesn't it? It many cases it can be used effectively and for the greater good. In other hands, it is unconstitutional and detrimental. That's why we must be very careful who we allow to have such powers.
